If you thought the Hemp regulatory landscape was confusing, guess what? It’s still confusing! But there is a glimmer of hope that the current Hemp Industry which was carved out by the 2018 Farm Bill may continue to allow all hemp products to be sold in states that do not specifically prohibit them.
To give you a little more background, recently the “Miller” Amendment was proposed by Rep. Mary Miller (R-Ill.) which would change the current law to allow only “non-intoxicating cannabinoids”. This amendment would be very bad news for the growing hemp industry, specifically Delta-8 derived from hemp. Luckily, a bi-partisan group of legislators, including: Morgan McGarvey (D-KY) Thomas Massie (R-KY), James Comer (R-KY), Andy Barr (R-KY), Mark Pocan (D-WI), and Nancy Mace (R-SC) have introduced their own amendment, authored by McGarvey to continue the current Farm Bill regulations that do allow for the sale of D-8 and other hemp-derived cannabinoids. Ultimately, we do not yet know what amendments, if any, will be included in the new bill but the bipartisan support and push back against needless prohibitions is a great sign. Here’s hoping the more informed, and cooler heads, prevail!
